How MUD Taxes Work in Texas

A MUD is a political subdivision usually created in areas where city utilities may not be available, such as:

  • Newer developments
  • Master-planned communities
  • Certain areas outside city limits, including extraterritorial jurisdictions (ETJs)

The Texas Commission on Environmental Quality (TCEQ) authorizes and regulates MUDs.

Under Texas law, MUDs serve as taxing entities that collect funds from residents to finance the construction, operation, and maintenance of essential facilities within the district’s boundaries.

While MUDs are common in Texas, other U.S. states have similar special government entities that charge property taxes under varying names and rules.

Here’s how MUD taxes work:

  • A developer builds the community’s initial infrastructure and utility systems, including water, wastewater, sewage, drainage, roads, and recreational facilities.
  • The MUD issues bonds and uses the proceeds to reimburse the developer for approved infrastructure costs.
  • Homeowners repay the bonds and continue supporting ongoing maintenance, operations, and improvements through the MUD tax.

A board of directors governs the MUD, sets tax rates, manages infrastructure, and oversees operations.

Over time, the MUD tax may decrease as the bonds get repaid and more homeowners join the tax base. This means more established districts with lower debt loads and more residents likely have lower MUD taxes than newer districts.

Based on 2025 adopted rates, here are MUD tax estimates from three municipal utility districts in Texas. I’ve calculated the MUD tax based on a home with a $350,000 taxable value using the following formula:

The MUD tax is one component of your property tax bill. The MUD, which is an independent taxing unit, charges the tax instead of a city or county.

  • School district taxes
  • County taxes

Are MUD Taxes Deductible in Texas?

Yes, MUD taxes are deductible as local property taxes for eligible taxpayers.

When filing federal taxes, you must itemize your deductions to claim them. MUD tax deductions are subject to the federal SALT (state and local tax) deduction limit.

 

Remember: Utility charges, such as water and sewer usage fees, are not deductible as property taxes.

Is the MUD Tax Eligible for a Homestead Exemption?

In many cases, no. Municipal Utility Districts are independent taxing entities, which is why the $140,000 general residence homestead exemption does not apply to MUD taxes.

However, a MUD may adopt its own local homestead exemption and offer other exemptions to qualifying individuals.
